A RESOLUTION DETERMINING TO PROCEED WITH THE

SUBMISSION TO THE ELECTORS DECLARING THE AMOUNT

OF TAXES THAT MAY BE RAISED BY LEVY AT THE MAXIMUM RATE AUTHORIZED BY LAW WITHOUT A VOTE OF THE ELECTORS TO BE INSUFFICIENT AND DECLARING THE NECESSITY OF A LEVY IN EXCESS OF  SUCH RATE FOR PROVIDING SUFFICIENT AND PROPER FUNDS FOR USE IN THE GENERAL FUND OF THE CITY OF CORTLAND, COUNTY OF TRUMBULL, STATE OF OHIO FOR THE PURPOSE OF PROVIDING FUNDS FOR THE OPERATING EXPENSES OF THE CITY OF CORTLAND PERSONNEL AND EQUIPMENT FOR THE PROTECTION OF THE PROPERTY WITHIN THE CITY OF CORTLAND, OHIO AND DECLARING THE NECESSITY OF THE LEVY IN EXCESS OF SUCH RATE

 

WHEREAS,  on July 5th , 2011 the Council of the City of Cortland adopted Resolution  R-21-11 to submit to the electors of the City of Cortland the question of levying a renewal in excess of the ten-mill limitation, as described below, a copy of the Resolution was certified to the Auditor of Trumbull County; and,

 

WHEREAS,  a copy of Resolution R-21-11 was certified to the County Auditor on July 6th , 2011; and,

 

WHEREAS,  that the County Auditor has certified to the City of Cortland that the annual tax levy required throughout the life of the proposed levy to produce the annual amount of  $ 236,723.00 as set forth in said Resolution; calculated in the manner provided by law, is 1.9 mills for each one dollar of valuation, which amount to nineteen cents ($0.19) for each one hundred dollars of valuation.

 

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CORTLAND, COUNTY OF TRUMBULL, STATE OF OHIO:

 

TWO-THIRDS OF ALL THE MEMBERS ELECTED THERETO CONCURRING:

 

Section 1.  That the amount of taxes that may be raised by the said Council of the City of Cortland, in the City of Cortland, Ohio, to provide funds for operating expenses by levy of the maximum rate authorized by Section 5705.02 of the Ohio Revised Code will be insufficient, and that it is expedient to levy taxes in excess of such limitation for the purpose of providing funds for the operating expenses of the General Fund of the City of Cortland, and increase rate over the maximum of not to exceed one and nine-tenths mills for each one hundred dollars of valuation for a period of not exceeding five years beginning with the tax year 2012.

 

            SAID LEVY BEING A 1.9 MILL RENEWAL OF AN EXISTING

            LEVY - TO PROVIDE THE SUFFICIENT FUNDS FOR OPERATING

            EXPENSES IN THE GENERAL FUND OF CORTLAND, OHIO

 

BE IT FURTHER RESOLVED:  That the provisions of the said tax levy be submitted to the electors of the City of Cortland, Ohio, at the next General Election to be held on the 8th day of November, 2011 and that these proceedings shall be conducted under favor of Section 5705.19 of the Ohio Revised Code, in the manner provided by law.

 

BE IT FURTHER RESOLVED:  That the Clerk of Council be and she is hereby directed to certify a copy of the Resolution to the Board of Elections, Trumbull County, Ohio, in order that the said Board of Elections may make the necessary arrangements for submission of such question to the Electors of said City of Cortland, Ohio, at said regular election in the manner provided by law.

 

BE IT FURTHER RESOLVED:  That the Form of Ballot to be used for submitting the question of such tax levy to the Electors of said City of Cortland, Ohio, and to be cast at such election, shall be as follows:

A renewal of 1.9 mills to constitute a tax for the benefit of the City of Cortland GENERAL FUND - for the purpose of current expenses for said GENERAL FUND at a rate not exceeding:  1.9 mills  for each one dollar of valuation, which amounts to nineteen cents ($0.19) for each one hundred dollars of valuation for a period not to exceed five (5) years beginning with the tax year 2012, said renewal tax of an existing tax.

BE IT FURTHER RESOLVED:  That this Resolution is deemed necessary for the preservation of public peace, property, health and safety and shall take effect as early as allowed by law.
