AN ORDINANCE AUTHORIZING THE LAW DIRECTOR OF THE CITY OF CORTLAND TO PROCEED WITH THE ANNEXATION OF THE WATER WELLFIELD PROPERTY OWNED BY THE CITY OF CORTLAND AND LOCATED IN THE TOWNSHIP OF BAZETTA.
WHEREAS, on December 29, 2006, the City of Cortland purchased 10.56 acres of land in Bazetta Township for the purpose of expanding the City’s water supply through the construction of a new water well field; and
WHEREAS, the purchase of this property is recorded in the Trumbull County Official Records as Instrument No. 200612290037523; and
WHEREAS, the City of Cortland is deemed an owner of real property pursuant to Ohio Revised Code Section 709.02; and
WHEREAS, it is in the best interest of the City of Cortland to have its own water supply and to have the water wellfield property be located wholly within the City borders.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CORTLAND, OHIO:
Section 1. That the Council of the City of Cortland does hereby appoint the Law Director as its Agent and does hereby authorize the Law Director of the City of Cortland to proceed with filing an annexation petition with the Trumbull County Commissioners according to law for the following real property:
Situated in the Township of Bazetta, County of Trumbull and State of Ohio:
And known as being a part of Lot Number Ten (10) in the original survey of said Township, and is bounded and described as follows: Beginning at an iron pin at the intersection of the center line of Warren-Meadville Road with the center line of the Bradley-Brownlee Road; THENCE N. 89º 20’ E. along the center line of said Bradley-Brownlee Road, being also the Township line between Bazetta and Mecca Townships, a distance of One Hundred Sixty (160) feet to an iron pin at the northeast corner of lands heretofore conveyed by Richard E. Godwin and Florence A. Godwin, husband and wife, to Ross W. Baker, by deed dated April 22, 1956; filed for record April 26, 1956 and recorded in Trumbull County Records of Deeds, Volume 652 at Page 53, and which is the place of beginning of the parcel herein described; THENCE continuing N. 09º 20’ E. along the center line of said Bradley-Brownlee Road, to the Township line between Bazetta and Fowler Townships; THENCE southerly along the township line between Bazetta and Fowler Township, to a point marking the northeast corner of lands now or formerly of Chas. W. Coon; THENCE N. 84º 23’ W. along the northerly line of
lands, now or formerly of Chas. W. Coon, to an iron pin at the southeast corner of lands conveyed to Ross W. Baker, as aforesaid; THENCE N. 20º 03’ E. along the easterly line of said Ross W. Baker lands, as aforesaid, a distance of 788.65 feet to an iron pin at the place of beginning, and containing within said bounds about 10.56 acres of land, be the same more or less, but subject to all legal highways, and being the remainder of the lands acquired by Richard E. Godwin and Florence A. Godwin, by Robert J. Kilpatrick, single, under date of April 21, 1956, by deed recorded in Trumbull County Records of Deeds, Volume 652 at Page 51.

Section 2. That the Law Director of the City of Cortland is authorized to take any and all steps necessary to annex the above described property, thereby bringing said property within the City’s borders, which property will house the City’s newest Water wellfield.
Section 3. This Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
