AN ORDINANCE AUTHORIZING THE CITY OF CORTLAND TO ENTER INTO A CONTRACT WITH DIORIO PAVING, INC. FOR THE 2011 ASPHALT  RESURFACING PROGRAM AND DECLARING AN EMERGENCY

 

WHEREAS,  there is a need for the 2011 Asphalt Resurfacing Program which includes the resurfacing of the following streets:  

 

Windsor Drive, Fairview Street, Second Street, Erie Street (from S. Mecca to W. Main)  Pearl Street (from N. Mecca to Rail Road) Fox Run, Fox Trail, Hickory Trail, Hawthorne Trail (cul-de-sac), Elizabeth Court, Michaels Court, Adams Court, Monte Lane, Louis Blvd., Tami Court, Alyssa Court  and Carl Street

 

WHEREAS,  the Council of the City of Cortland authorized the advertisement for bids for the 2011 Asphalt Resurfacing Program in R-15-11; and,

 

WHEREAS,  the Clerk of Council has advertised for bids in accordance with said authorization; and,

 

WHEREAS,  on the 23rd of June 2011, bids were opened and Diorio Paving Inc. was the lowest responsible bidder in the amount of $283,404.17; and,

 

NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CORTLAND, OHIO:

 

Section 1.  That the Council of the City of Cortland does hereby authorize the Mayor of the City of Cortland, Ohio to enter into a contract with Diorio Paving Inc., 1200 South State St #A, Girard, OH 44420-3309.

 

Section 2.  The total cost of the project is $283,404.17 which will come out of the following funds:

           

            General Fund                         10-J-234                      $ 183,404.17

M & R Fund                           40-J-234                      $   65,000.00

Permissive Tax Fund             46-J-234                      $   35,000.00

            TOTAL                                                                       $ 283,404.17

           

Section 3.  The Finance Director of the City of Cortland shall be authorized to make payment to Diorio Paving Inc. upon completion of said project and upon having approval of the Service Director that said work is done according to specifications as set forth by the City of Cortland.

 

Section 4.  This ordinance having the procedural rules suspended shall take effect immediately as being necessary to expedite the roadway project and protect the health, safety and welfare of the residents of the City of Cortland, Ohio.
